Justin T. Bailey

When it comes to practicing law, my philosophy is to treat every case as though it is an opportunity to impact someone’s life in a beneficial way. As lawyers we are called upon to take what is most important to the client and help them through a situation that they never wanted to find themselves in.  It is in this moment that we get an opportunity to deliver and make an impact, and the impact we make is entirely up to us.  

Mr. Bailey focuses his practice on construction defect litigation, first party insurance claims, complex commercial litigation, business disputes, business formation, and matters involving intellectual property.  Mr. Bailey has served as general counsel to several businesses and has assisted those businesses in complex merger and acquisition matters, employment matters, and litigation when necessary to protect business interests.  Mr. Bailey also represents clients in complex product liability matters, class actions, mass torts, and qui tam litigation.  

Mr. Bailey began working for the Albany County Public Defender’s office under student practice order in 2009 and continued work as a dedicated advocate with a passion for protecting the rights of the indigent accused beyond graduation from law school. Mr. Bailey handled numerous criminal cases ranging from minor traffic offenses and DUI cases to aggravated robbery cases and sexual offense cases.  Mr. Bailey further worked on Sex Offender Risk Assessment hearings with a goal towards transitioning convicted offenders back into societal life and conducted several motions and evidentiary hearings.  Following this, Mr. Bailey moved back home to Colorado and took a position practicing in the Mass Torts and Civil Litigation fields.  Mr. Bailey was involved in complex litigations involving product liability including Avandia, SSRI, Risperdal/Invega, General Motors Ignition Switch Defect, Xarelto, Essure, and Zofran litigations. 

Mr. Bailey was further involved in environmental actions which included cases related to violations of the Clean Water Act along with major chemical spills and releases which have caused significant harm to residents within the spill zones.  Mr. Bailey has also participated and filed actions in copyright, major personal injury, auto accident, premises liability, medical and professional malpractice and entertainment law cases, including a successful declaratory action against a major Hollywood studio on behalf of a small independent filmmaker, actions involving celebrities, and several successful actions on behalf of individuals injured by the negligence of others.  

Mr. Bailey’s considers his most meaningful professional accomplishment to be securing a substantial settlement exceeding statutory caps for a man that entered the hospital with a broken rib but left brain dead due to the negligence of a physician and hospital staff.  Mr. Bailey not only helped secure the funds the man needed to receive the critical care he required for the remainder of his life but also was able to assist in removing him from the care of his spouse who became abusive to him following his critical injury.
