Overview

John J. Truitt is a Partner in the Firm’s Litigation Practice Group and focuses his practice on business and commercial litigation, employment litigation, construction litigation, real estate litigation, trust and probate litigation, securities litigation, e-commerce matters, and complex civil disputes in state and federal courts.

John routinely litigates complex, multiparty matters across a wide range of substantive areas, including corporate governance disputes, shareholder and ownership disputes, fiduciary litigation, business fraud, fraudulent transfers, officer and director liability, construction claims, employment disputes, restrictive covenants, non-compete and non-solicitation agreements, trade secrets, contract disputes, real estate conflicts, securities-related claims, and trust and probate litigation.

In addition to his litigation practice, John maintains a robust e-commerce practice, advising clients on legal and regulatory issues affecting companies that sell, advertise, market, and operate in the digital marketplace. His work includes counseling clients on Federal Trade Commission compliance, advertising and marketing practices, vendor and platform relationships, and disputes arising from e-commerce operations. John has also litigated matters involving e-commerce businesses and the commercial and regulatory issues that arise in that space.

Before entering private practice, John served as a deputy sheriff with the Collier County Sheriff’s Office in Naples, Florida, where his experience included road patrol, work as a detective in the Violent Crimes Bureau, and service as a member of the SWAT team. He later served as a prosecutor with the Office of the State Attorney for the Twentieth Judicial Circuit, where he handled serious felony cases and economic crime matters, and developed extensive trial experience at both the jury and bench levels.

By way of recent representative matters, John obtained a seven-figure settlement on behalf of a corporate officer and shareholder in a dispute against a corporate defendant involving the breach of an employment agreement, unpaid contractual severance compensation, and complicated shareholder-related issues. The settlement followed John’s success in non-binding arbitration, his defeat of all counterclaims at the summary judgment stage, and his successful opposition to the corporate defendant’s motion for summary judgment on the client’s claims, leaving those claims positioned for trial and creating substantial trial risk for the defendant.
